Taqseem-E-Meeras
Note: To use this table, the reader should first ascertain whether the deceased left a wife or husband, and if she or he survived, should look under the appropriate heading. Only in default of either should search be made under "sons and daughters", "father and mother" and the rest, and then in the order given in the first margin. In each instance it is supposed that there are no nearer relations than those named.

(1) Re Mutchilim [1960] M.L.J. 25.
(2) The daughters in such case being residuaries with the son.
(3) The son's daughters being residuary with the son's son.
(4) An example of the doctrine of aul or increase.
(5) The mother gets 1/3 of ¾ (that is after deducting the wife's share). This follows a decision of the Caliph Umar.
(6) The brothers and the sisters are residuaries.
(7) An example of aul.
|
(8) The son's son and son's daughter are residuaries.
(9) Example of aul or increase.
(10) Examples of aul or increase
(11) In these cases the daughter and son's daughter get their Quranic shares while the sister takes as residuary.
(12) The mother gets 1/3 of ½ (that is after deducting the husband's share).
(13) The brothers and sisters are residuaries.
(14) This is the case of himariyya or musharaka. The full brother and the uterine sisters share the 1/3 share. See Fitzgerald Muhammadan Law p.135 and Nawawi Supra, p.250.
(15) This is the case of Al-akdariya - see Tyabji Muhammadan Law (3rd Edn.) p.874 and Fitzgerald Muhammadan Law p.128 and Nawawi p.253 Supra, (p.22 supra)
(16) This is the case of al-Malikia - see Fitzgerald p.128.
|
(17) There is a doubt whether the son's daughters (who are excluded as Quranic heirs) are nevertheless entitled to take as residuaries together with the agnatic ascendant or collateral. See Fitzgerald Muhammadan Law, p.124.
(18) In all these cases, as there are two daughters the son's daughter cannot inherit as Quranic heir. She therefore takes as an agnatic heir and shares the residu with the lower son's son.
(19) The son's daughter is a residuary with an equal son's son.
(20) As there is a "nearer" daughter, the share of the son's son's daughter is 1/6 that is the remainder of the 2/3 share of daughters.

Divorce in Islam
There are 3 Types of Divorces in Islam
First type is Talaq E Bidat.
Talaq Talaq Talaq go at the same time
2nd Type is Talaq E Hasan.
Give Talaq and wait for 1 month and then give second and wait and then final 3rd one
3rd Type is Talaq E Ahsan which is best way as explained in Quran
(Surah Al Baqarah Ch 2 Verse 228)
When ever you give Divorce wait for three 3 months or three Menstrual cycles to complete Divorce duration
Unfortunately there is a conflict in umah but there is a Hadis by Hazrat Abbas (RA) (Sahih Muslim Vol 2 Hadis No 3491) says :
(That the pronouncement of three divorces during the life time of Allahs Messenger (PBUH) and that of Abubakar(R.A) and two year of Calaphate of Umar (R.A) was treated as one. But Omer (R.A) said: Verily people have begun to hasten in the matter in which they are required to respite. So if we had imposed this upon the, and he imposed it upon them.)
During Holy prophet (PBUH) life 3 Divorces were considered as one as explained in Quran which is three months process, even in Hazarat Abubakar's (RA) Life it remained same however in Umers Regimes first 2 years it remains the same and then Umer (R.A) after observing the situation , said if some one give Divorce 3 times it is considered as complete divorce.
But if you look in the light of Holy Quran (Surah Al Baqarah Verse 228 – 240) and
(Surah Talaq V 1-7)
Quran says whenever there is a difference of opinion between Husband and Wife, sit together and discuss and try to resolve the issue. If it doesn’t work Allah says in (Surah nisah V 35)
Then get one Arbiter from woman side and one Arbiter from Mans side and try to resolve it, if it don’t get resolved then give divorce
And the best way is to wait for three months if during these three months you (Husband and Wife) come together Alhamdullilah its ok, but if after three months you decide that you cannot stay together... they you are no more husband and wife
(Surah baqrah V 232)
(.... Reference from Dr Zakir Naik Speech.....)
Explained as If that Man (Husband) want to get married with his old Wife don’t stop him, if divorce is happen in the Ehsan Divorce way
He can have Nikah with his old wife with different Mehar. (but this thing can happen 3 times)
But unfortunately not all Muslims don’t adopt Ehsan Procedure of Divorce.
